TERMS AND CONDITIONS
RESERVATIONS AND PAYMENT.
A deposit is required to be made at the time of booking a vacation in order to secure a reservation. Sixty (60) days prior to departure all deposits become final and non-refundable. Full payment of all remaining amounts due over and above the deposit amount must be paid on or before sixty (60) days prior to departure. In the event full payment is not received on or before sixty( 60) days prior to departure, all reservations, including but not limited to airline reservations, will be cancelled. Special payment policies may apply depending upon the choice of excursions and will be advised at the time of booking. I Viaggi Di Burgio SRL d/b/a Excursions by Burgio (hereinafter “Excursions by Burgio”) is not responsible for any Supplier-imposed fees or penalties or price increases (including butnot limited to Supplier fare differentials) resulting from late payment. "Supplier" shall refer to the vendors providing transportation, sightseeing arrangement, tours, excursions, accommodations and other travel products and services. Submission of any payment to Excursions by Burgio shall constitute customer'sacceptance of these Terms & Conditions.
FORMS OF PAYMENT. Excursions by Burgio accepts payment by bank transfer, PayPal, debit andcredit card payments via American Express, Visa, MasterCard, including the option to use a combinationof these payment methods for the same booking. Personal checks are not accepted.
LAST-MINUTE RESERVATIONS. Reservations may be accepted up to forty-five (45) days prior todeparture for certain destinations, subject to availability. Last-minute reservations, if accepted, will be subject to extra fees incurred due to late booking of Suppliers.
CHANGES PRIOR TO DEPARTURE. Excursions by Burgio, may assess a fee for each customer-initiated change to the reservation after receipt of payment,, Hotel and/or Supplier fees or fare/price differentials, may also be charged. Any change made will result in the reservation being re-priced at therate in effect at the time of the requested change.
DOCUMENTS. Documents will be issued on fully paid reservations approximately 21 days prior todeparture. A document reissue fee of $35 per booking in addition to any Supplier fees and expediteddelivery service fees will be assessed for the replacement of lost or destroyed documents.
CANCELLATIONS & REFUNDS. Excursions by Burgio, will assess a fee for cancellations, which maybe equal to, but will not exceed, the total vacation package price. Additional Supplier- or third-party travelagency- or third-party travel advisor-imposed cancellation fees may also be charged. Once travel hasbegun, there will be no refunds for any unused or partially used travel component for any reason, otherthan as required under applicable law. While every effort will be made to provide all items on the travelitinerary as booked, Excursions by Burgio reserves the right to cancel or alter any reservation for anyreason prior to departure. Should this occur, refunds will be made without any further obligation byExcursions by Burgio. Except where prohibited by applicable law, Excursions by Burgio reserves the rightto issue Future Travel Credit (“FTC”) in lieu of refunds at its sole discretion, in the event of cancellationscaused by events or circumstances beyond its reasonable control, including but not limited to, acts ofgovernments, epidemics, medical quarantines, severe weather conditions, war, hostilities, or terroristacts or threats. The FTC is nontransferable, nonrefundable, has no cash value and cannot be used topurchase a travel protection plan. FTC is issued with expiration dates and must be used prior toexpiration. Standard change and cancellation policies apply to bookings made with FTC.Pre-Departure
Cancellation Fees:• For cancellations made 45 days prior to departure: no refund will beissued• For cancellations made 60 days prior to departure: 50% refundable• For cancellations made up to 61days prior to departure: 100% refundableIf a travel package or reservation is being purchased through a third-party travel advisor, such advisormay charge service fees in addition to fees charged by Excursions by Burgio. Third-party travel advisorsmay also charge additional cancellation fees. Please consult with your travel advisor regarding any suchadditional fees.1663719.1NO-SHOWS. Failure to travel without prior notification to Excursions by Burgio is considered a no-show,in which case the entire reservation shall be non-refundable.Travel Insurance. Excursions by Burgio maintains a minimum coverage necessary by Italian law. Travelinsurance is highly recommended per person, for accidents and disruption of travel.
CHANGES AFTER DEPARTURE. No refunds will be granted on unused services once travel hascommenced. Excursions by Burgio will assess a $100 per person fee for itinerary changes made aftercommencement of travel. Such changes to the extent permitted by carrier(s)' tariffs (i) may be made onlythrough Excursions by Burgio’ representatives, and (ii) are subject to Supplier-imposed fees, penalties, orprice increases (including without limitation Supplier fare differentials), which are payable directly toExcursions by Burgio at the time of change.
RATES. All rates are quoted in U.S. Dollars unless otherwise noted. Rates are subject to change at anytime, without notice. Excursions by Burgio reserves the right to make adjustments if a particular rate wasincorrectly stated. Rates are subject to increase prior to receipt of full payment, and Excursions by Burgiocan guarantee rates only for reservations paid in full (except as otherwise provided below); it is thereforerecommended that full payment be made at time of booking. Rates are not subject to increase after fullpayment, except as a result of increases in government-imposed taxes or fees (applicable to allreservations) or Supplier-imposed fees (applicable only to reservations that do not include an aircomponent). Rates include charges for planning, managing, and administering the sale of vacationpackages, hotels, and other travel products, and are subject to change without notice. Travel packagesinclude transportation to and from the airport, to and from planned excursions, meals, tips, plannedwinery tours and tastings, lodging, planned excursions, selected 60 days prior to departure date, winesselected and purchased by a member of our team during meals and winery.
RATES DO NOT INCLUDE. Unless specifically noted otherwise, prices do not include, airfare, airlineseat assignment/seat selection fees, baggage fees or other ancillary fees for optional services, travelprotection plan coverage, passport and visa fees, some departure taxes, telephone calls, foreign currencyexchange fees, minibar charges, wine beyond what is ordered or provided at meals and winery tastings,room service, COVID-19 tests, quarantine accommodations due to governmental restrictions, or othercharges of a personal nature.
AIR TRANSPORTATION. Excursions by Burgio has no control over and assumes no liability for airlinestrikes, schedule changes, flight delays, flight cancellations or other airline initiated changes. In the eventof such an occurrence, the airline is responsible and will determine what action will be taken. In caseswhere a flight segment on a single ticket itinerary to, from, or within the United States is either cancelledor significantly delayed or changed by the airline, any refund, if due, shall be handled in accordance with14 CFR Part 260.
AIRCRAFT DISINSECTION. Some countries may require aircraft cabin insecticide treatment for in-boundforeign flights. A list of such countries is available at https://www.transportation.gov/airconsumer/sprayACCOMMODATIONS. Facilities, guest services, amenities, energy surcharges, resort fees, third or fourthadult in room charges, and other charges of a personal nature are provided at the discretion of theExcursions by Burgio and are subject to change without notice. Such charges, which are not payable toExcursions by Burgio, are the responsibility of the customer and are payable directly to the hotel.Room/cabin location, connecting rooms and bedding requests are not guaranteed and are based uponavailability at time of check in. Hotel room descriptions, including reference to square footage informationare approximate only, may contain inaccuracies and are also subject to availability at time of check-in.Hotel ship descriptions and photos do not necessarily depict the actual room/cabin in which guests will beaccommodated; maps and images may not be exact or to scale, and are for general description purposesonly. Accommodations will change per location and trip. Accommodations will range from countrysidevillas to hotels in select cities and towns.1663719.1Hotel stays do not earn or qualify for any points, awards, airline miles or elite status upgrades under anyhotel loyalty or frequent guest program. Hotel deposits will be made by Excursions by Burgio. Hotelbeaches, shorelines and ocean conditions are subject to change due to storms, erosion damage, wind,wave heights, swells, coastal flooding, sea level rise and other conditions including seaweed, Sargassum,rocks, debris, flooding and other conditions which may limit access orclose beachwalks and roads.
BAGGAGE AND PERSONAL PROPERTY. Baggage checked or carried on board an aircraft, vessel orvehicle are subject to fees based on weight, number and size. All baggage fees are theresponsibility of the customer and are payable directly to the supplier. Please contact theSupplier for their current baggage policy. Some airlines may charge additional fees for sportsequipment including golf clubs, surf boards and similar items. Excursions by Burgio is notresponsible or liable for any delay, loss or damage to baggage and personal property.PHYSICAL DISABILITIES. Customers requiring special facilities, services or accommodations mustdisclose such needs to Excursions by Burgio at time of reservation, except where applicable law prohibitsExcursions by Burgio from requiring such disclosure. Wheelchair-accessible transportation andaccommodations may be requested, but cannot be guaranteed. Many villages, villas, vineyards, and townsare not accessible by wheelchairs in Italy. Available accommodation standards vary by airline, hotel andand are not within the control of Excursions by Burgio. Your foreign destination may not conform to theUnited States' Americans with Disabilities Act (ADA) requirements, and facilities for disabled persons maybe extremely limited. Excursions by Burgio assumes no liability for the failure for the provision ofaccommodations by a travel vendor.
PEANUT ALLERGIES. Airlines cannot guarantee nut-free flights and customers are encouraged to review all health concerns with their physicians prior to flying.
CUSTOMER IDENTIFICATION AND PROOF OF CITIZENSHIP. The Transportation SecurityAdministration (TSA) requires all airline passengers to provide the following Secure FlightPassenger Data (SFPD):• Full Name as it appears on the Passenger’s Government-Issued I.D.• Date of Birth• Gender• Known Traveler Number (if available)• Redress Number (if available)Names and birthdates provided to Excursions by Burgio for airline, hotel and cruise line customers mustbe an exact match to the photo ID that will be used during travel. The customer is responsible for all fees and expenses that may be incurred due to an incorrect name, or to the denial of travel due to an incorrect name. A name revision fee of $50 per person will be assessed by Excursions by Burgio for namecorrections or revisions, in addition to other fees assessed by airlines or other Suppliers. Updated information regarding security measures and requirements for air travel are available at www.tsa.gov. It is highly recommended that customers check the foregoing website for possible changes due tosecurity measures applicable to air travel to/from their scheduled destination(s).1663719.1You acknowledge and agree that you are responsible for determining and obtaining any requiredtravel documents, for both domestic and international destinations, complying with all entry/exitand other governmental travel requirements or restrictions applicable to/from/within yourdestinations of travel, and complying with all Supplier requirements for travel, including, withoutlimitation, completion of health forms and provision of any required health test results. For more information, please visit: https://travel.state.gov/content/travel/en/international-travel.html, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac, and www.cbp.gov. An entry visa and passport may be required for travel. It is the customer’s responsibility to verify that a passport is valid at the time of departure, remains valid for a minimum of six months beyond the return travel date, and contains sufficient BLANK pages to attach any required visas for their travel. At least one person occupying a room must be 18 years or older to check into a hotel or other accommodations. Please verify the most current documentation and entry requirements with the country’s consulate or at www.travel.state.gov. No refund will be issued for losses incurred as a result of failure to obtain or provide required valid documentation. Check with www.travel.state.gov, not only for entry requirements into foreign countries and returns to the U.S., but also for any restrictions that may prevent you from entering in to a foreign country. State Department travel advisories are also on this site.
DOMESTIC AIRLINE TRAVEL REAL ID REQUIREMENTS FOR U.S. CITIZENS.
Every air traveler 18 years of age and older must present a REAL ID-compliant driver’s license, state-issued enhanced driver’s license, or other acceptable form of identification, such as a valid passport or U.S. Military ID, to fly within the United States. Standard, i.e., non-REAL ID compliant or non-enhanced, driver’s licenses are not accepted by the Transportation Security Administration (TSA) at airport security checkpoints. Individuals for whom the TSA is unable to verify identity will not be able to clear TSA checkpoints at airports and fly. For more information about REAL ID, visit tsa.gov/real-id.
AIRLINE CONDITIONS OF CONTRACT AND OTHER IMPORTANT NOTICES.
ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATIONS OF LIABILITY PASSENGERS EMBARKING UPON A JOURNEY INVOLVING AN ULTIMATE DESTINATION OR A STOP IN A COUNTRY OTHER THAN THE COUNTRY OF DEPARTURE ARE ADVISEDTHAT THE PROVISIONS OF AN INTERNATIONAL TREATY (THE WARSAW CONVENTION,THE 1999 MONTREAL CONVENTION, OR OTHER TREATY), AS WELL AS A CARRIER’SOWN CONTRACT OF CARRIAGE OR TARIFF PROVISIONS, MAY BE APPLICABLE TO THEIRENTIRE JOURNEY, INCLUDING ANY PORTION ENTIRELY WITHIN THE COUNTRIES OFDEPARTURE AND DESTINATION. THE APPLICABLE TREATY GOVERNS AND MAY LIMIT THE LIABILITY OF CARRIERS TO PASSENGERS FOR DEATH OR PERSONAL INJURY, DESTRUCTION OR LOSS OF, OR DAMAGE TO, BAGGAGE, AND FOR DELAY OF PASSENGERS AND BAGGAGE. ADDITIONAL PROTECTION CAN USUALLY BE OBTAINED BY PURCHASING INSURANCE FROM A PRIVATE COMPANY. SUCH INSURANCE IS NOT AFFECTED BY ANY LIMITATION OF THE CARRIER’S LIABILITY UNDER AN INTERNATIONAL TREATY. FOR FURTHER INFORMATION PLEASE CONSULT YOUR AIRLINE OR INSURANCE COMPANY REPRESENTATIVE.1663719.1NOTICE OF LIABILITY LIMITATIONS. The Montreal Convention or the Warsaw Convention system may be applicable to your journey and these Conventions govern and may limit the liability of air carriers for death or bodily injury, for loss of or damage to baggage, and for delay. Where the Montreal Convention applies, the limits of liability are as follows:
1. There are no financial limits in respect of death or bodily injury.
2. In respect of destruction, loss of, or damage or delay to baggage, 1,519 SpecialDrawing Rights per passenger in most cases.
3. For damage occasioned by delay to your journey, 6,303 Special Drawing Rights perpassenger in most cases.
EC Regulation No. 889/2002 requires European Community carriers to apply the provisions of the Montreal Convention limits to all carriage by them of passengers and their baggage by air. Many non-European Community carriers have elected to do so in respect of the carriage of passengers and their baggage.
Where the Warsaw Convention system applies, the following limits of liability may apply:
1. 16,600 Special Drawing Rights in respect of death or bodily injury if the Hague Protocol to the Convention applies, or 8,300 Special Drawing Rights if only the Warsaw Convention applies. Many carriers have voluntarily waived these limits in their entirety, and US regulations require that, for journeys to, from or with an agreed stopping place in the US, the limit may not be less than US $75,000.
2. 17 Special Drawing Rights per kg for loss of or damage or delay to checked baggage, and 332 Special Drawing Rights for unchecked baggage.
3. The carrier may also be liable for damage occasioned by delay. Further information may be obtained from the carrier as to the limits applicable to your journey. If your journey involves carriage by different carriers, you should contact each carrier for information on the applicable limits of liability. Regardless of which Convention applies to your journey, you may benefit from a higher limit of liability for loss of, damage or delay to baggage by making at check-in a special declaration of the value of your baggage and paying any supplementary fee that may apply. Alternatively, if the value of your baggage exceeds the applicable limit of liability, you should fully insure it before you travel.
Time limit for action. Any action in court to claim damages must be brought within two years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived.
Baggage claims. Written notice to the carrier must be made within 7 days of the receipt of checked baggage in the event of damage, and, in the event of delay, within 21 days from the date on which it was placed at the disposal of the passenger.1663719.1
NOTICE OF CONTRACT TERMS INCORPORATED BY REFERENCE.
1. Your contract of carriage with the carrier that provides you with carriage by air, whether international, domestic or a domestic portion of an international journey is subject to this notice; to any notice or receipt of the carrier; and to the carrier’s individual terms and conditions (Conditions), related rules, regulations and policies (Regulations) and any applicable tariffs.
2. If your carriage is by more than one carrier, different Conditions, Regulations and any applicable tariffs may apply for each carrier.
3. The Conditions, Regulations and any applicable tariffs of each carrier are, by this notice, incorporated by reference into and made part of your contract of carriage.
4. The Conditions may include, but are not restricted to:\
a) Conditions and limits on the carrier’s liability for the bodily injury or death of passengers.
b) Conditions and limits on the carrier’s liability for the loss of, damage to or delay ofgoods and baggage, including fragile or perishable goods.
c) Rules for declaring a higher value for baggage and for paying any supplementary feethat may apply.
d) Application of the carrier’s Conditions and limits of liability to the acts of the carrier’sagents, servants and representatives, including any person providing either equipmentor services to the carrier.
e) Claims restrictions, including time limits by which passengers must file claims or bringactions against the carrier.f) Rules about reconfirmations or reservations; check in times; the use, duration andvalidity of air transportation services; and the carrier’s right to refuse carriage.
g) Rights of the carrier and limits on the carrier’s liability for delay or failure to perform aservice, including schedule changes, substitution of alternative carriers or aircraft andre-routing, and, when required by applicable law, the obligation of the carrier to notify passengers of the identity of the operating carrier or substituted aircraft.
h) Rights of the carrier to refuse carriage to passengers who fail to comply with applicable laws or who fail to present all necessary travel documents.
5. You can obtain additional information on items (a) through (h) above at any U.S. location where the transporting air carrier’s tickets are sold.
6. You have the right to inspect the full text of each transporting carrier’s terms at its airport and city ticket offices. You also have the right, upon request, to receive free of charge thefull text of the applicable terms incorporated by reference from each of the transporting carriers. Information on ordering the full text of each carrier’s terms is available at any U.S.location where the air carrier’s tickets are sold.
7. If a carrier sells air transportation services or checks baggage specifying carriage onanother carrier, it does so only as agent for the other carrier.CARRIERS RESERVE THE RIGHT TO REFUSE CARRIAGE TO ANY PERSON WHO HAS ACQUIRED A TICKET IN VIOLATION OF APPLICABLE LAW OR THE CARRIER’S TARIFFS,RULES OR REGULATIONS.YOU CANNOT TRAVEL IF YOU DO NOT HAVE ALL REQUIRED TRAVEL DOCUMENTS,SUCH AS PASSPORT AND VISA. PASSENGER SHALL ARRIVE AT AIRPORT BY TIMEEARLY ENOUGH TO COMPLETE DEPARTURE PROCEDURES. EXCURSIONS BY BURGIO ISNOT RESPONSIBLE FOR AND SHALL HAVE NO LIABILITY FOR ANY LOSS OR DAMAGE RESULTING FROM INSUFFICIENT OR IMPROPERLY ISSUED PASSPORTS, VISAS OR OTHER GOVERNMENT DOCUMENTS.1663719.1GOVERNMENTS MAY REQUIRE YOUR CARRIER TO PROVIDE INFORMATION ON OR PERMIT ACCESS TO PASSENGER DATA, INCLUDING INFORMATION WE MAY BE REQUIRED TO COLLECT FROM YOU DURING THE RESERVATION PROCESS.
U.S. NOTICE—OVERBOOKING OF FLIGHTS.
Airline flights may be overbooked, and there is a slight chance that a seat will not be available on a flight for which a person has a confirmed reservation. If the flight is overbooked, no one will be denied a seat until airline personnel first ask for volunteers willing to give up their reservation in exchange for a payment of the airline’s choosing. If there are not enough volunteers, the airline will deny boarding to other persons in accordance with its particular boarding priority.
With few exceptions, persons denied boarding involuntarily are entitled to compensation.
The complete rules for the payment of compensation and each airline’s boarding priorities are available at all airport ticket counters and boarding locations. Some airlines do not apply these consumer protections to travel from some foreign countries although other consumer protections may be available. Check with theairline or your travel agent.
EUROPEAN NOTICE—DENIED BOARDING/CANCELLATIONS.
For all flights departing from theEuropean Union and all flights to the European Union if on an European operating carrier, if you are denied boarding or your flight is cancelled or delayed for at least two hours, ask at the check-incounter or boarding gate for the text stating your rights, particularly with regard to compensation and assistance. For further information on your air passenger rights for these flights, see http://europa.eu/youreurope/citizens/travel/passenger-rights/air/index_en.htm.
BAGGAGE. Excess valuation may be declared on certain types of articles. Carriers may applyspecial rules for fragile, valuable, or perishable articles. Check with your carrier. Checked Baggage: Carriers may permit a free checked baggage allowance, which is set by the carrier andmay differ by class, and/or route. Carriers may apply extra charges for checked baggage in excess of their permitted allowance. Check with your carrier. Cabin (Unchecked) Baggage: Carriers may permit a free cabin baggage allowance, which is set by the carrier and may differ by class, route, and/or aircraft type. It is recommended that cabin baggage be kept to a minimum. Check with your carrier. If more than one carrier is providing the transportation for your journey, each carrier may apply different rules on baggage (both checked and cabin).
SPECIAL BAGGAGE LIABILITY LIMITATIONS FOR U.S. TRAVEL.
For domestic travel whollybetween U.S. points, federal rules require any limit on a carrier’s baggage liability to be at least US$4,700 per passenger, or the amount currently mandated by 14 CFR § 254.5.
CHECK-IN TIMES. The time shown on the itinerary/receipt is the departure time of the aircraft.Flight departure time is not the same as the time you must check-in or the time you must beavailable for boarding. Your carrier may refuse you carriage if you are late. Check-in times, asadvised by your carrier, are the latest times at which passengers can be accepted for travel;boarding times, as advised by your carrier, are the latest times at which passengers must presentthemselves for boarding. Flight cannot be held for late-arriving passengers, and Excursions byBurgio accepts no responsibility in such cases.DANGEROUS GOODS. U.S. Federal law forbids the carriage of hazardous materials aboardaircraft in your luggage or on your person. A violation can result in five years' imprisonment andpenalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives,compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactivematerials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) ofmedicinal and toilet articles carried in your luggage and certain smoking materials carried on yourperson. Lithium ion batteries cannot be included in checked luggage. Excursions by Burgio is only responsible for reserving theitems listed in the reservation details.SUPPLIERS ARE INDEPENDENT CONTRACTORS AND ARE NOT EMPLOYEES OR AGENTS OF IVIAGGI DI BURGIO SRL, d/b/a EXCURSIONS BY BURGIO OR ANY OF EXCURSIONS BY BURGIO SUBSIDIARIES, PARENTS, AFFILIATES, OR RELATED COMPANIES. EXCURSIONS BYBURGIO IS ACTING SOLELY AS A SALES AGENT FOR SUPPLIERS IN CONNECTION WITH THESETERMS & CONDITIONS. EXCURSIONS BY BURGIO HAS NO OWNERSHIP INTEREST IN ANYSUPPLIER.THE FACT THAT EXCURSIONS BY BURGIO PROVIDES INFORMATION REGARDING THE AVAILABILITY OF ANY PRODUCT OR SERVICE DOES NOT MEAN EXCURSIONS BY BURGIO IS ENDORSING OR RECOMMENDING THE PRODUCT OR SERVICE. ANY USE OF THE I VIAGGI DIBURGIO SRL, d/b/a EXCURSIONS BY BURGIO NAME BY A SUPPLIER IS FOR IDENTIFICATION PURPOSES ONLY AND DOES NOT CONSTITUTE OWNERSHIP, AGENCY, SUPERVISION OR CONTROL BY EXCURSIONS BY BURGIO. ALL DOCUMENTATION, RECEIPTS AND TICKETS ARE ISSUED SUBJECT TO THE TERMS AND CONDITIONS SPECIFIED BY THE SUPPLIER. EXCURSIONS BY BURGIO MAKES NO IMPLIED OR EXPRESS WARRANTIES IN THE OFFERING OF ANY TRAVEL PRODUCTS OR SERVICES DESCRIBED IN THESE MATERIALS. MISCELLANEOUS.
These Terms & Conditions cannot be changed or amended except in writing, signed by an authorized officer of Excursions by Burgio. The customer contract in use by the airline, when issued, constitutes the sole agreement between you and the airline. Excursions by Burgio reserves the right to decline to accept or retain any person as a member of the vacation at any time prior to departure or duringthe course of the vacation. In the unlikely event that the services or accommodations are not available asstated, due to reasons beyond Excursions by Burgio’s control, efforts will be made to provide services or accommodations of equal standard and quality.ARBITRATION. Any dispute arising out of, or relating to, any vacations offered shall be submitted to binding arbitration under Italian law.
